1. The following definitions shall apply:
a ) The “Company” shall be NEXT LEVEL DETAILING LTD.
b ) The “Customer” shall be the company, entity, or person on whose behalf the Company shall provide the agreed Services and responsible for settlement of the Company’s fees.
c ) The “Services” shall be those tasks carried out by the Company on behalf of the Customer.
2. Agreement to Standard Terms & Conditions (STCs)
a ) By appointing the Company, the Customer acknowledges that he has sufficient notice of the STCs and is bound thereto.
b ) Unless there is a separate written Agreement, the instruction by the Customer is irrevocably agreed as being subject to these STCs.
c ) The STCs may only be amended by written agreement between the Company and the Customer.
d ) In the event of a conflict between the STCs and any written Agreement, the terms of the Agreement shall prevail.
3. Customer Obligations
a ) Any Service booked will be booked in co-operation with the Company, who will advise in most cases of the appropriate Service level based upon the information provided by the Customer. Should the Customer choose a lower service than is appropriate for the condition of the vehicle, or than is recommended by the Company, the Company will not warrant to the lesser services effectiveness.
b ) If the Customer wishes to cancel for any reason, they must give at least 24 hours notice, and this must be acknowledged by the Company 24 hours before the booked date. Failure to do so will incur a cancellation charge in all cases which may be up to 100% of the cost of the Service.
c ) The Customer must ensure, prior to arrival of the Company that the vehicle is emptied of all personal and non-fixed items within the car. The Company reserves the right and the Customer hereby acknowledges that right to either make a further charge for clearance of the Customer’s vehicle or refuse to undertake the service which will be treated as a late cancellation and thus a charge will be levied.
d ) The vehicle is booked without being seen in advance and as such the level of service and estimated completion time may alter. Any alteration of Service will be advised of but not compulsory and will not be charged for or proceeded with, until the agreement of the Customer has been sought.
e ) The arrival time is estimated and can fluctuate due to a variety of reasons including the condition of a previous car, weather, traffic, and other circumstances outside the control of the Company. This is not the liability of the Company, and it shall not, nor can it ever be held liable for such occurrences.
f ) Any Service preferences from the Customer e.g. (no tyre dressing / no fragrances) must be stated prior to the Company providing its Service. The Company will provide the highest quality standard of work using a variety of products it chooses from its inventory.
g ) The Customer must provide the Company with access to one standard power socket for the Company to perform its Service. In the unlikely event that power is not available at the Service location, the Company may still charge the Customer in full.
4. Liabilities
a ) All vehicles are cleaned and moved at the Customer’s own risk and the Company shall not be responsible for any losses whatsoever, whether to the Customer, or to third parties.
b ) The Company will not accept liability for any loss or damage to personal belongings left in a vehicle whilst it is being worked upon.
c ) The Company will not be held responsible for any damage to your vehicle arising from poor fitting trim, loose or faulty parts etc. The Customer must inform the Company of any potential problems before the Company provides its Service.
5. Force Majeure
a ) Neither the Customer nor the Company shall be liable to the other for failure to honour its obligations due to causes beyond its reasonable control.
6. Service Fees
a ) Service Fees shall be calculated either by reference to the Company’s relevant scale in operation at the material time or by separate agreement between the parties. Fee scales for various services are always available upon request.
b ) The Company’s Service Fees become payable immediately upon presentation.
c ) Service Fees are payable in full without set-off or deduction in respect of any other Services or subject matter.
7. Public Liability Insurance
a ) The Company will maintain Public Liability insurance cover up to £2 Million.
